1. OUR TERMS OF USE. These Terms of Use (“Terms”) apply to this website and any mobile application, and any websites or mobile applications that display or link to these Terms (collectively, the “Sites”). The Sites provide information about our dealership, vehicles, products, and services, and may include tools that allow you to communicate with us, request information, schedule service, build and price vehicles, apply for financing, receive offers, or otherwise interact with us (collectively, the “Services”).

2. ACCEPTANCE OF TERMS. By accessing or using any portion of the Sites or Services, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not access or use the Sites or Services.

We may operate additional websites or mobile applications that are governed by separate terms.

6. VEHICLE INFORMATION – NO OFFER. All vehicle listings, pricing, incentives, availability, specifications, and descriptions are provided for informational purposes only and do not constitute an offer to sell or lease any vehicle. Prices, availability, and incentives are subject to change without notice and may vary based on financing approval, manufacturer programs, trade-in qualifications, or other factors. Please contact the dealership directly for current and binding information.

7. COMMUNICATIONS & TCPA CONSENT. By entering and submitting your contact information through the Sites, you expressly consent to receive communications from us and our service providers, including calls, prerecorded or artificial voice messages, text messages (SMS/MMS), and emails, using automated or non-automated technology, regarding vehicles, pricing, financing, service, promotions, and related matters, consistent with applicable law.

8. USER CONDUCT. You may not:

  • Impersonate another person or entity;
  • Submit false, misleading, or fraudulent information;

  • Use the Sites for unlawful or harmful purposes;
  • Upload or transmit malicious code or content; or
  • Attempt to interfere with the operation or security of the Sites.

11. TRADEMARKS & COPYRIGHT. All trademarks, logos, and content on the Sites are owned by or licensed to us. Unauthorized use is prohibited.

We comply with the Digital Millennium Copyright Act (“DMCA”). Copyright complaints may be submitted as described in the “Contact Us” section below.

12. CHILDREN. Our Services are not directed to children under 13 years of age, and we do not knowingly collect personal information from children under 13. If we learn that we have inadvertently collected personal information from a child under 13, we will take reasonable steps to delete such information.

13. INDEMNIFICATION. You agree to indemnify and hold harmless the dealership and its affiliates, owners, officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Sites or violation of these Terms.

14. LIMITATION OF LIABILITY. To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive damages. Our total liability for any claim shall not exceed $10.00.

15. ARBITRATION & CLASS ACTION WAIVER. PLEASE READ THIS SECTION CAREFULLY.

Any dispute arising out of or relating to these Terms, the Sites, or the Services shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules.

  • Governing Law: Pennsylvania law, without regard to conflict-of-laws principles

CLASS ACTION WAIVER:

You and we agree that any dispute shall be brought only in an individual capacity and not as a plaintiff or class member in any class, collective, or representative action.

Either party may seek injunctive relief for unauthorized use of the Sites or intellectual property violations.

16. COMPLIANCE WITH LAW ENFORCEMENT. We may disclose information as required by law or legal process, or to protect rights, safety, or property.

17. CORPORATE TRANSACTIONS. We may transfer information as part of a merger, sale, reorganization, or similar transaction.

18. GENERAL PROVISIONS. If any provision is unenforceable, the remaining provisions remain in effect. These Terms constitute the entire agreement regarding your use of the Sites.

19. CHANGES TO TERMS. We may update these Terms at any time by posting revised Terms. Continued use of the Sites constitutes acceptance.
